beneficial ownership

being entitled, pursuant to a legal relationship, to all rights and powers in respect of an item of property except for the right to delivery, and being obliged to take responsibility for all obligations relating to that item of property and hence bearing the complete risk of the item of property losing value or being destroyed, without the item of property being delivered
